Terms of Use

1. The Service

FocusNow is a productivity tracking tool. The desktop app records which applications and windows you use on your own device, organizes that activity into sessions and analytics, and can generate AI-assisted daily reports. Some features require an account and an internet connection; activity tracking runs locally on your device.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the FocusNow desktop application on devices you own or control, for your own use. You may not copy, modify, distribute, sell, rent, sublicense, reverse engineer, or attempt to extract the source code of the Service, except where such a restriction is prohibited by law.

3. Your Account

You sign in to FocusNow with a Google or Microsoft account. You are responsible for keeping access to that account secure and for all activity that happens under it. You must provide accurate information and be legally capable of entering into these Terms. FocusNow is not intended for children under 13 (or the applicable minimum age in your jurisdiction).

4. Acceptable Use

You agree not to:

• Use the Service to monitor another person or their device without their knowledge and lawful consent — FocusNow is a self-tracking tool, not an employee or family surveillance product
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its infrastructure, or other users' data
• Use the Service in violation of applicable laws or regulations
• Resell, redistribute, or offer the Service to third parties as your own product
• Circumvent or attempt to circumvent technical limitations or security measures of the Service

5. Free Plan and Future Paid Plans

FocusNow is currently free to use. We may introduce paid plans with additional features in the future; if we do, pricing and terms for those plans will be communicated clearly before you are charged anything. We may also change, limit, or discontinue features of the free plan, with reasonable notice where the change is material.

6. AI-Generated Content

Daily reports and insights are generated by artificial intelligence based on your activity data. AI output can be incomplete, inaccurate, or misleading. Insights are provided for your personal information only and do not constitute professional, medical, legal, or employment advice. You should not make significant decisions based solely on AI-generated content.

7. Privacy

Our Privacy Policy explains what data we collect and how we handle it, and forms part of these Terms. By using the Service, you acknowledge the Privacy Policy at focusnow.ai/privacy.

8. Updates and Availability

The desktop app may download and install updates automatically to keep the Service secure and functional. We aim to keep the Service available but do not guarantee uninterrupted or error-free operation, and we may suspend the Service for maintenance. Cloud sync and AI features depend on third-party infrastructure and may be temporarily unavailable.

9. Intellectual Property

The Service, including its software, design, branding, and content (excluding your data), is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding. You retain all rights to your own activity data; you grant us only the rights needed to operate the Service for you, as described in the Privacy Policy.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be accurate, reliable, uninterrupted, or error-free, or that activity data will never be lost. Keep your own backups of anything critical.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of or inability to use the Service. To the extent permitted by law, our total liability for all claims relating to the Service shall not exceed the amount you paid us for the Service in the twelve months before the claim (or 50 USD if you have paid nothing). Nothing in these Terms excludes liability that cannot be excluded by law, including mandatory consumer rights in your country of residence.

12. Termination

You may stop using the Service at any time and may request deletion of your account as described in the Privacy Policy. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service; where reasonably possible, we will give you advance notice so you can export your data.

13. Governing Law

These Terms are governed by the laws of the Republic of Turkey, and the courts of Turkey have jurisdiction over disputes arising from them. If you are a consumer in the European Union or elsewhere, you also benefit from any mandatory protections of the law of your country of residence, and this clause does not deprive you of them.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or the website before the changes take effect. Your continued use of the Service after the changes become effective constitutes acceptance of the updated Terms.
